Saving / Limitation of Liability

This clause applies to your use of the GST Notice Reply Drafting Assistant (the “tool”), operated by Gstian Software Solutions Private Limited (the “tool owner”). It supplements, and where inconsistent prevails over, any general limitation-of-liability language in the Terms of Use.

1. Best-efforts security basis

The tool is provided on a best-efforts security basis. The tool owner uses reasonable technical and organisational measures — as described in the Cyber-Attack & Data Safety Policy — but does not warrant that the tool will be uninterrupted, error-free, or completely free from cyber-attacks, unauthorised access, or data loss. No online system can be guaranteed to be immune from every threat.

2. User-side compromise

To the maximum extent permitted by applicable law, the tool owner is not liable for any loss or damage arising from a compromise of your own device, email account, browser, other applications installed on your device, or any third-party service used to access the tool, including any loss of data held in those other applications.

3. Cap on aggregate liability

To the maximum extent permitted by applicable law, the tool owner’s total aggregate liability for any and all claims arising out of or relating to the tool — whether in contract, tort (including negligence), statute, or otherwise — is limited to the subscription fees actually paid by you for the tool in the three (3) months immediately preceding the event first giving rise to the claim. Where no subscription fees have been paid by you in that period, the cap is zero.

4. Exclusion of indirect damages

To the maximum extent permitted by applicable law, the tool owner is not liable for any indirect, consequential, special, incidental, or exemplary damages, including without limitation loss of business, loss of profits, loss of goodwill or reputation, loss of personal photos or videos, or loss of data held in other applications on your device, even if advised of the possibility of such damages.

5. User precautions and own-risk use

Users agree to take their own precautions to protect their devices and accounts — including using up-to-date antivirus software, strong and unique passwords, and safe browsing practices — and acknowledge that they use the tool at their own risk within the limits stated in this clause.

6. Non-excludable rights

Nothing in this clause limits or excludes any liability that cannot be limited or excluded under applicable law, including under the Consumer Protection Act, 2019, the Information Technology Act, 2000, or the Digital Personal Data Protection Act, 2023. Where such non-excludable rights apply, they are unaffected by the caps and exclusions above.
